Article 1 – Scope of Application

These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all sales of digital products (ebooks, PDF files, MP3 files, videos, online courses, etc.) concluded by [at home] (hereinafter “the Seller”) with non-professional or professional customers (hereinafter “the Client” or “the Clients”) via the website [here] or any other remote sales channel.

Article 2 – Product Description

The products offered are digital files delivered instantly via download or online access after payment has been validated. No physical shipment is carried out.

Article 3 – Prices

Prices are indicated in euros (€), all taxes included (VAT at the applicable rate). The Seller reserves the right to modify prices at any time, it being understood that the price applied is the one in effect at the time of the order.

Article 4 – Order and Payment

The order is considered final once full payment has been received. Payment is made through [Stripe, PayPal, etc.]. Upon receipt of payment, the Client automatically receives a download link or immediate access to the product.

Article 5 – Immediate Delivery

In accordance with Article L221-28 of the French Consumer Code, digital products provided on a non-material medium and executed immediately after payment are considered delivered instantly.

Article 6 – No Right of Withdrawal

In accordance with Article L221-28 13° of the French Consumer Code, the 14-day withdrawal right does not apply to contracts:
“for the supply of digital content not provided on a physical medium where performance has begun after the consumer has given prior express consent and expressly waived their right of withdrawal.”

By validating the order and ticking the box “I accept the Terms & Conditions and expressly waive my right of withdrawal” (or equivalent), the Client agrees that the provision of the digital product begins immediately and expressly waives their right of withdrawal.

Article 7 – Legal Warranty

Digital products are covered by the legal warranty against lack of conformity and hidden defects under Articles L217-4 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.

Article 8 – Intellectual Property

All content (texts, images, videos, etc.) remains the exclusive property of the Seller. Any reproduction, distribution, or resale is strictly prohibited and constitutes an act of counterfeiting.

Article 9 – Liability

The Seller cannot be held liable in the event of misuse of the digital product or inability to access it due to a technical issue on the Client’s side (internet connection, compatibility, etc.).

Article 10 – Customer Support

Any technical support request or question must be addressed by email to: [contact@àlamaison.tech]. Responses will be provided within a maximum of 48 business hours.

Article 11 – Personal Data

Collected data is processed in accordance with the GDPR. The Client has the right to access, rectify, and delete their personal data by writing to the above email address.

Article 12 – Applicable Law and Jurisdiction

These GTC are governed by French law. Any disputes shall be submitted to the competent courts.
